to establish a storyline that republicans are intent on obstructing president obama's judicial nominees. that storyline patently ridiculous in light of the facts and utterly absurd suggestion in light of the facts. before this current democratic gamut to fill up the d.c. circuit one way or the other, the senate had confirmed 215, 215 of the president's judicial nominees and rejected two. that's a 99% confirmation rate. 215 confirmed and two rejected. 99%. look, if advise and consent is to mean anything at all occasionally consent is not given. but by any objective standard senate republicans have been very, very fair to this preside president. we've been willing to confirm his nominees. in fact, speaking of the d.c. circuit we just confirmed one a few months ago 97-0 to the d.c. circuit. so i suggest our colleagues take a time out. stop trying to jam us, work with us, instead to confirm vacancies that actually need to be filled which we have been doing. this rules change rate has gone from being a biennial threat to an annual threat, now to a quarterly threat. how many times have we bee

to obama care? republicans in congress are all about numbers these days. gop members have released new documents showing just six people successfully enrolled on the first day of the new health care exchange. now, six the first day, just 248 more by day two and according to an aide for these republican committee members, a laundry list of issues kept people from getting on the site and getting the job done. >> we're working every day to make improvements to this wholly unsatisfactory website. i want to make clear nobody is more unsatisfied with the way that website has performed since the launch than the president of the united states. but we're working every day to improve it. >> so there is new evidence of a growing group within the president's own party that they are revolting against the problems plaguing the health care rollout. following the rollout of obama care for exactly the reasons jimmy was just spelling out there. americans now give republican lawmakers a slight edge over their democrat colleagues. if next week's elections were held today, look at that, incumbent republican senators face nearly all of the primary challenges come 2014 elections. so how are republicans going to battle the tea party and democrats in general, because they have got to go for it on both sides? >> right, it's a tough thing. this is one of the things we've had in the republican party for quite some time. i think as you mentioned early, politically obama care is the gift that keeps on giving. this website -- it will be fixed sooner or later. but one of the issues brought up in congressional testimony not too long ago from one of sebelius' folks was basically that 40% of the website, the back end of the website, the important part that actually gets the money to the insurers, that actually pays for the claims hasn't even been built yet. >> right. >> and he said, oh, don't worry about it, we have until january 1st. it's not even built.

, not once, but twice and that's obviously the obama campaign and they believe at least on social issues they successfully painted him as somebody who was too conservative for the mainstream. it doesn't surprise me that that's going to be the tactic that they use. if you look at virginia, we're seeing this is a successful strategy right now, that the brand of the republican party particularly on social issues. all republicans are vulnerable to this because they end up having to own sort of where the entire party is sitting on social issues, but it will be difficult. if new jersey is a place for gay marriage. if this is a guy that's walking hand in hand in the boardwalk with barack obama while they're playing see ball together. it will be hard for the average voter to think, yeah, that guy is -- especially if ted cruz is running. >> and another place like south carolina, especially an average voter. >> chuck todd, thank you so much, sir. >> catch "the daily rundown" week days 9:00 a.m. eastern. let's bring in former pennsylvania governor ed rendell who is new an msnbc news political analy

all of these showdowns in the senate about president obama trying to get federal judges confirmed. a very basic presidential duty. so the fifth circuit is known to be very, very conservative. it wants to overturn roe v. wade. so the appeals trial in january is expected to not go in favor of the medical providers who brought that suit, but it is -- justice briar actually said yesterday in his order that he expects that the supreme court will have to say whether creating these medically unnecessary restrictions on clinics that will force them to close their doors is against the constitutional standard that this is a right that women can pursue. >> and as we drill down just a little deeper, specifically on the state level, tennessee and utah enforce laws on admitting privileges. similar laws are under temporary court injunctions in alabama, kansas, mississippi, north dakota and wisconsin. so as those states are being watched on a national level just like we saw in albuquerque being taken down to a local level, where does the fight march from there? >> well, it's clear that the suprem

, the military is also facing budget taker issues, as well. president obama will be sitting down with pentagon brass as the senate takes a look at military spending. in the "wall street journal," as congress fwirds for its next budget battle, the willingness of rank and file republicans to cut the once sack crow sanction pentagon budget is bolstering the negotiation position of gop leaders. are we about to see a shift where the budget hawks will give a knockout to the war hawks? >> the pentagon already has been struck in year because of the sequestration cuts. there is also a strong group of both republicans and democrats who believe that the military budget should not be cut even the 4% or so that it's been cut under the sequester. it's actually less than 4%. so i'm not ready to call it a paradigm shift. you hear the nsa revelations, you have increasing discussion of drone warfare. none of which are particularly by the way large budget items. an f-22 fighter plane is a large budget item. but it does draw attention to what are we spending it on and how much should we be spending. and clearly t
